By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following privacy policy as stated in this Policy (hereafter referred to as 'Privacy Policy'), along with the terms and conditions as stated in our Terms and Conditions (please refer to the Terms and Conditions section below for more information).

This Privacy Policy (“Policy”) applies to any users of Bizzcart or its affiliates anywhere in the world, including any users of Bizzcart’s websites, features, apps, or other services, and to anyone else who contacts Bizzcart or otherwise submits information to Bizzcart, unless noted below. This includes those who use Bizzcart or its affiliates' services to advertise, post ad, post task, post rental, post video, offer rideshare, host guest, perform task, purchase promotional offers and/or package, place promotional ad, sell or purchase goods or services, make payment or withdraw money from Bizzcart Wallet, any other user of Bizzcart's online stores, shopping services, other services including apps, websites and Application Programming Interface (API), and anyone else who contacts Bizzcart or otherwise submits information to Bizzcart, unless subject to a separate privacy policy, notice or agreement.

Bizzcart (hereinafter referred to as “Bizzcart”, “we”, “us”, “our”, “Services”, “Platform”, “Mobile App”, “Account”, “Wallet”, “Dashboard”, “Bizzcart Services”, “Bizzcart Platform”, “Bizzcart Shopping”, “Bizzcart Wallet”, “Wallet Services”, “Bizzcart App”, “website” or “Bizzcart Stores”) operates a platform and community marketplace that helps people make transactions on goods and services, including but not limited to, exchange, offer, purchase, sell, rent, fundraise, and advertise online directly with one another, whether through our website or our mobile applications (“Platform”). Bizzcart refers to Bizzcart Inc. if you reside in Canada or outside Canada.

This privacy policy has been compiled to better serve those who are concerned with how their "Personally Identifiable Information" (PII) is being used online. PII is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our Privacy Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your PII in accordance with our website.

This Policy applies to all sites, mobile applications, and other online services (collectively, "Platform") made available by Bizzcart. This Policy applies only to information collected on or through the Platform. It does not apply to information collected or obtained by or through any other means (including, without limitation, information collected offline, in person, over the telephone and/or by mail, or from third parties outside the Platform). By accessing or using the Platform, you agree to this Policy. These Terms apply to all sites, mobile applications, and other online services (collectively, "Platform") made available by Bizzcart. These Terms apply only to information collected on or through the Platform. It does not apply to information collected or obtained by or through any other means (including, without limitation, information collected offline, in person and/or over the telephone). By accessing or using the Platform, you agree to these Terms. Definitions

Where the definition of a term does not appear in this Privacy Policy, it shall be given its definition as outlined in our Terms and Conditions.

  • “Affiliates” means financial or non-financial companies related by common ownership or control.
  • “Aggregated Information” means information about all users or specific groups or categories of users that we combine together so that it no longer identifies or references an individual user.
  • “Third Parties” means companies or persons not related by common ownership or control (i.e., non-affiliates) or other unrelated individuals. Third Parties can be financial and non-financial companies, or persons other than you and Bizzcart.
  • “Personal Information” means information (which may include sensitive information) relating to a living individual who is or can be identified either from that information or from that information in conjunction with other information that is in, or is likely to come into, the possession of the Data Controller.
  • “Data Controller” is a person, company, or other body that determines the purpose and means of personal data processing (this can be determined alone, or jointly with another person/company/body).

 

What personal information do we collect from the people, clients, customers, merchants, merchants’ customers, partners, support users and forum users that visit our blog, website or app?

When visiting, registering, ordering, posting ad, posting task, posting rental, posting video, offering rideshare, approving a task, approving a rental booking, approving a customer to a rideshare booking, hosting a guest, assigning a task, verifying user’s credentials, verifying tasker’s credentials, verifying driver’s credentials, verifying host’s credentials, advertising on our site, as appropriate, we may collect your name, company name, personal address, business address, mailing address, shipping address, billing address, phone number(s), cellphone number(s), email address, date of birth, passport information, bank account information, payment details, bank routing numbers, credit card details, and any other payment information, business type, business ID number, IP address, device and browser data, PayPal account, network connection, chat transcript, tax number (eg. GST/HST) and information, website URL, twitter or other social media handles and government-issued identification information, such as your Social Security Number or your Social Insurance Number or, alternatively, if you are Canadian and elect not to provide your Social Insurance Number, a copy of your government-issued identification.

We may also collect data about how and when you access your account, including personal information when you sign up for our Bizzcart Platform, when you access our services or otherwise provide us with the information; personal information about your customers that you share with us or that customers provide while shopping or during checkout; how and when you access your account, including information about the device and browser you use.

We will use Personal Information in other cases where you have given us express permission.

When do we collect information?

We collect information from you when you surf the website, register on our site, place an order, post or enter an ad, post or enter a task, post or enter a rental, post or enter a video, post or enter a rideshare, advertise a product or a service, make a purchase, withdraw funds, subscribe to a newsletter, respond to a survey, fill out a form, Use Live Chat, Open a Support Ticket, enter information on our site or provide us with feedback on our products or services.

Why do we collect this information?

We may use the information we collect from you in the following ways:

  • Enable you to access and use the Bizzcart Platform and to communicate with other Members.
  • Personalize your experience and allow us to deliver the type of content and product offerings in which you are most interested.
  • Improve our website in order to better serve you.
  • Allow us to better service you in responding to your customer service requests.

  • Enable you to access and use the Payment Services and the Wallet Services.

  • Verify or authenticate information or identifications provided by you (such as to verify your Accommodation address or compare your identification photo to another photo you provide).

  • Resolve any disputes with any of our users and enforce our agreements with third parties.
  • Enforce our Terms and Conditions and other policies.
  • Send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your communication preferences, including information about Bizzcart or partner campaigns and services.
  • Administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Bizzcart or its third party business partners.

 

Analyzing your Communications

We may review, scan, or analyze your communications on the Bizzcart Platform for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, and customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze messages to mask contact information and references to other websites. In some cases, we may also scan, review, or analyze messages to debug, improve, and expand product offerings. We may use automated methods where reasonably possible. However, occasionally we may need to manually review some communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your communications to send third party marketing messages to you, and we will not sell reviews or analyses of these communications.

How do we protect your information?

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user places an order, submits, or accesses his information to maintain the safety of his personal information. All transactions are processed through a gateway provider and are not stored or processed on our servers.

Financial Information

We use Financial Information solely as authorized by you in accordance with the Bizzcart Platform. To keep your financial data secure, we do not store full credit card information on our servers. We have contracted with a third party to process your payment card information.

Operating globally

As described in this Privacy Policy, we may sometimes share your information within our family of companies or with third parties. When you use the Bizzcart Platform, you authorize us to transfer, store, and process your information in Canada and possibly other countries. Laws in these countries may differ from the laws applicable to the place where you live. For example, information collected within the Residents of the European Economic Area (“EEA”) may be transferred, stored, and processed outside of the EEA for the purposes described in this Privacy Policy. By using the Bizzcart Platform, you consent to transferring your data to these countries.

Transfer of Data for Users outside of Canada

We primarily store data about you, including personal information, on servers located and operated within Canada. If you reside outside of Canada, in order to provide and operate the Bizzcart Platform, we may send and store your personal information (also commonly referred to as personal data) outside of the country where you reside or are located. Therefore, our collection and use of your personal information is subject to Canada’s laws related to privacy and use of personal data and information. These laws, including what is determined to be “personal data and/or information,” are different and may be less protective than those applicable to you in your country of residence. By accepting the terms of this Privacy Policy, you acknowledge, agree and consent to (1) the transfer to and processing of personal information on servers located outside of the country where you reside, (2) our collection and use of your personal information as described herein and in accordance with the laws of Canada that may be different and may be less protective than those in your country and (3) that you are taking a risk by using the Bizzcart Platform. EU-US Privacy Shield

Bizzcart is a participant in the Privacy Shield and has self-certified to the Privacy Shield framework. Bizzcart confirms it commitment to comply with the EU-US Privacy Shield as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union (“EU”) member countries. Bizzcart has certified that it adheres to each of the Privacy Shield Principles: Notice, Choice, and Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Residents of the European Economic Area and Japan

Bizzcart may works with clients, customers, merchants, partners and users around the world, including in the EEA and Japan. Please note that as part of our service, we may transfer your personal information to other regions, including to Canada and the United States.

Additionally, if you are located in the EEA, you have certain rights under European law with respect to your personal data, including the right to request access to, correct, amend, delete, or limit the use of your personal data. In order to exercise these rights, please reach out to us using the contact information below.

If you reside in the EU or Japan, you may request in writing copies of your personal information held by us. We will provide you with a copy of the personal information held by us as soon as practicable, and in any event not more than 40 days after receiving a valid request in writing. There may be a charge to access your personal data. We may request proof of identification to verify your access request.

If your personal information that we hold is inaccurate, let us know and we will update the relevant information. You may also request the erasure of your personal information in accordance with the relevant data protection legislation. We will notify you within 40 days of your valid request about the relevant action taken.

European Union Residents: Access and Challenge Information Provided to Us by Third Parties

You are entitled to see and challenge information third parties provide to us as part of our fraud detection, prevention and risk assessment efforts if all of the following factors apply: (i) we use third parties to carry out automated checks or risk assessments, (ii) we make a decision which has legal consequences for you or which significantly affects you, and (iii) such decision is based solely on such automated checks or risk assessments.

Consent to Transfer

Our computer systems are currently based in Canada, so your personal data will be processed by us in Canada, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. If you create an Account with the Platform as a visitor from outside Canada, by using the Bizzcart Platform, you agree to this Policy and you consent to the transfer of all such information to Canada, which may not offer a level of protection equivalent to that required in the European Union or certain other countries, and to the processing of that information as described in this Policy.

Corporate Affiliates

To help us provide the Bizzcart Platform, we may share your information within our corporate family of companies (both financial and non-financial entities) that are related by common ownership or control. These related entities are covered under this Privacy Policy.

Bizzcart reserves the right to transfer, sell and/or distribute all information collected through the Bizzcart Platform to an affiliate, subsidiary, or third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or part of our business, assets or stock. We will use our best efforts to ensure that the new entity follows this Privacy Policy with respect to your Personal Information, as and to the extent required by applicable law.

Tax Authorities

In jurisdictions where we facilitate the Collection and Remittance of Taxes, Bizzcart users expressly grant us permission, without further notice, to disclose data and other information relating to them or to their transactions, bookings, purchases to the relevant tax authority, including, but not limited to, the name, listing addresses, transaction dates and amounts, tax identification number(s), the amount of taxes received (or due) by users, and contact information.

Business Transfers

As we continue to develop our business, we might sell or buy stores, subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless the customer consents otherwise). Also, in the unlikely event that Bizzcart Inc., or substantially all of its assets are acquired, customer information will be one of the transferred assets.

Advertisements

Advertisements appearing on the Service may be delivered by us or one or more third-party web advertisers. These third-party web advertisers may set cookies. These cookies allow the advertisement server operated by that third party to recognize your computer each time they send you an online advertisement. Accordingly, advertisement servers may compile information about where or whether you viewed their advertisements and which advertisements you clicked on. This information allows web advertisers to deliver targeted advertisements that they believe will be of most interest to you. Profiles, Listings, and other Public Information

The Bizzcart Platform lets you publish information that is visible to the general public. Information you share publicly on the Bizzcart Platform may be indexed through third party search engines. In some cases, you may opt-out of this feature in your Account settings. If you change your settings or your public-facing content, these search engines may not update their databases. We do not control the practices of third-party search engines, and they may use caches containing your outdated information.

Public Areas

You may have the opportunity to create a profile, which consists of information about you, and may include Personal Information, photographs, work history, skills, hourly pay rates, feedback/rating information and other information, including your username (“Profile”). The information in your Profile may be visible to all Users and the general public subject to the privacy choices you make within your Profile. If you choose to post an ad, task, rental, video, rideshare, or sell a good or a service via the Bizzcart Platform, the contents of such listing will be publicly viewable.

Location Information

When you visit the Bizzcart Platform via a mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map to offer a better service for our Users. We will not share your current location with other users. If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.

Google Maps/Earth

Parts of the Bizzcart Platform use Google Maps/Earth services, including the Google Maps API(s). Use of Google Maps/Earth is subject to Google Maps/Earth Additional Terms of Use and the Google Privacy Policy. Some portions of the Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to Google’s terms of use (located at https://www.google.com/intl/en_us/help/terms_maps/) and Google’s privacy policy (located at https://policies.google.com/privacy), as may be amended by Google from time to time.

Statistics

We also collect statistics about use of the Service. This information will be kept confidential, however, aggregate statistics that do not personally identify an individual will be kept by us and such aggregate statistics may be made available to other members or third parties.

Reviews and Testimonials

If you provide ratings, feedback or testimonials (see further “Feedback” in the Terms and Conditions) you agree that we may use your name in connection with our publication and promotion of that feedback/testimonial.

Safety and Compliance with Law

Bizzcart Payments may share your personal information to: (i) provide the Payment Services, (ii) facilitate your use of the Bizzcart Platform, and (iii) jointly market products or services to you with other financial third parties with whom Bizzcart Payments has a formal agreement. You can unsubscribe or opt-out from receiving such marketing communications in your Account settings.

Bizzcart may disclose your information to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required to do so by law or if such disclosure is reasonably necessary: (i) to comply with legal process and to respond to claims asserted against Bizzcart, (ii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability, (iii) to enforce and administer our Terms and Conditions or other agreements with Members, (iv) for fraud investigation and prevention, risk assessment, customer support, product development and debugging purposes, or (v) to protect the rights, property or personal safety of Bizzcart, its employees, its Members, or members of the public. We will attempt to notify Members about these requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon Bizzcart’s property, its Members and the Platform (collectively, “Risk Scenarios”). In instances where we comply with legal requests without notice for these reasons, we will attempt to notify that Member about the request after the fact if we determine in good faith that we are no longer legally prohibited from doing so and that no Risk Scenarios apply.

California Online Privacy Protection Act

CalOPPA is a state law in the Unites States that requires commercial websites and online services to post a privacy policy. COPPA (Children Online Privacy Protection Act)

Updating, Deleting, and Correcting your Information

You may review, correct and delete certain information about you by logging in to the Bizzcart Platform and navigating to your preferences page in your “Dashboard." You must promptly update your Account information if it changes or is inaccurate. Upon your request, we will close your Account and remove your profile information from view as soon as reasonably possible. We may retain information from closed Accounts in order to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any user, enforce our Terms and Conditions, and/or for any other purposes otherwise permitted by law that we deem necessary in our sole discretion. You should understand, however, that once you transmit User Content through the Platform, you may not be able to change or remove it. Once we have deactivated or removed your Account, you agree that Bizzcart will not be responsible to you for retaining information related to your Account.

Bizzcart's Information Retention Policy
