By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this Terms (hereafter referred to as 'Terms and Conditions'), along with the terms and conditions as stated in our Privacy Policy (rental refer to the Privacy Policy section below for more information).

These Terms and Conditions (“Terms”) apply to any users of Bizzcart or its affiliates anywhere in the world, including any users of Bizzcart’s websites, features, apps, or other services, and to anyone else who contacts Bizzcart or otherwise submits information to Bizzcart, unless noted below. This includes those who use Bizzcart or its affiliates' services to advertise, post ad, post task, post rental, post video, post rideshare offer, host guest, rent to customer, perform task, drive customer, purchase promotional offers and/or package, place promotional ad, sell or purchase goods or services, make payment or withdraw money from Bizzcart Wallet, any other user of Bizzcart's online stores, shopping services, other services including apps, websites and Application Programming Interface (API), and anyone else who contacts Bizzcart or otherwise submits information to Bizzcart, unless subject to a separate privacy policy, notice or agreement.

If you are under the minimum age required in the jurisdiction where you reside to navigate and use the services provided through the website and Bizzcart App (for example, 18 or 21 years old), your legal guardian or parent must consent to your use of the services provided via the website and the Bizzcart App, and must accept these Terms and Conditions on your behalf. Your legal guardian’s or parent’s consent must be done in compliance the law(s) and regulation(s) in force in the jurisdiction where you reside.

By clicking “I accept”, registering for the services or posting an ad, task, rental, video, rideshare, or accepting to perform a task or renting to a customer or driving a customer, or otherwise using the website and Bizzcart App, you indicate your acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions, then do not use the website and Bizzcart App or any of its content or services.

These Terms and Conditions may be amended or updated by Bizzcart from time to time without notice and the Terms and Conditions may have changed since your last use of the Bizzcart Platform. It is your responsibility to review these Terms and Conditions for any changes. Your use after any amendments or updates of these Terms and Conditions shall signify your assent to and acceptance of such revised terms. Any new features that may be added to the service from time to time will be subject to these Terms and Conditions, unless stated otherwise.

Bizzcart (hereinafter referred to as “Bizzcart”, “we”, “us”, “our”, “Services”, “Platform”, “Mobile App”, “Account”, “Wallet”, “Dashboard”, “Bizzcart Services”, “Bizzcart Platform”, “Bizzcart Shopping”, “Bizzcart Wallet”, “Wallet Services”, “Bizzcart App”, “website”, “Bizzcart Stores”, “Rideshare Services”, “Customer Services”, “Rental Services”, “Task Services”, “Ad Services”, “Video Services”, “Rental Services”, or “Driver Services”) operates a platform and community marketplace that helps people make transactions on goods and services, including but not limited to, exchange, offer, purchase, sell, buy, rent, fundraise, and advertise online directly with one another, whether through our website or our mobile applications (“Platform”). Bizzcart refers to Bizzcart Inc. if you reside in Canada or outside Canada.

These Terms apply to all sites, mobile applications, and other online services (collectively, "Platform") made available by Bizzcart. These Terms apply only to information collected on or through the Platform. It does not apply to information collected or obtained by or through any other means (including, without limitation, information collected offline, in person and/or over the telephone). By accessing or using the Platform, you agree to these Terms. IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS AND CONDITIONS, THEN WE CANNOT PROVIDE THE PLATFORM OR SERVICES TO YOU, AND YOU SHOULD STOP ACCESSING THE PLATFORM, AND YOU SHOULD DEACTIVATE YOUR BIZZCART ACCOUNT. About the Bizzcart Platform

You can use the Bizzcart Platform from a computer or a mobile device if you have downloaded the Bizzcart App. Users, Buyers, Sellers, Customers, Rental Customers, Video Customers, Rideshare Customers, Ad Customers, Ad Providers, Task Providers, Rental Providers, Video Providers, Rideshare Providers, Tenants, Landlords, Hosts, Guests, Customers, Drivers, Freelancers, Independent Workers, Askers, and Taskers are collectively referred to as "Users".

The Bizzcart Platform allows users who to undertake the following transactions:

1. Post an ad on a range of goods and services;
2. Post a task. This feature allows the user to seek help for completing a variety of tasks such as home painting, cleaning, moving, plumbing, and other general tasks (“Tasker Services”) as further described on the website ("Task Providers"). Task Providers can connect through the website or Bizzcart App with other users ("Taskers" or “Freelancers”) who have registered on the website as able to complete certain tasks, and who wish to complete the tasks posted by the Task Provider (the "Service").
3. Post a rental. This feature allows the user (“Host” or “Rental Provider”) to advertise rental opportunities such as renting a condo, a house, a commercial space, a car, a parking lot, a boat, residential and commercial equipment, and other general rentals (“Rental Services”) as further described on the website ("Rentals"). Rental Providers can connect through the website or Bizzcart App with other users (“Guest” or “Rental Provider”) who have registered on the website to book certain rentals.
4. Post a video on a range of topics and get financial contribution for users subscribing or purchasing a right to download and/or view your video;
5. Offer a rideshare based on a range of criteria in terms of distance, pricing, location, on-demand versus recurring offers, and other criteria;
6. Work as a tasker. This feature allows the user to create a tasker account and apply for tasks that are offered on the Bizzcart Platform, and get a financial contribution for completing the task;
7. Work as a Rental Provider: This feature allows the user to advertise rentals on the Bizzcart Platform. Once a Rental Customer book a rental with the Rental Provider, the Rental Customer will be expected to pay for the service once it has been consumed.
8. Work as a driver. This feature allows the user register as a driver and offer rideshare on the Bizzcart Platform, and get a financial contribution for driving customers. In the jurisdictions where a rideshare is not authorized as a commercial activity, should the Law permit, driver may offer this service to off-set a portion of their transportation costs.

Ad Providers, Sellers and Buyers:

By using the Bizzcart Platform, you understand and acknowledge that we provide a service that allows sellers or buyers to post ads to inform other potential buyers or sellers about products and services they offer, look for or wish to trade, and that ad providers, buyers and sellers are fully independent and not employees or agents of Bizzcart.

We do not perform any of the buyer or seller or provider services listed on the website. Although we do not control buyers and/or sellers and/or providers work product, service or behavior on the job site, buyers and/or sellers are required, as a condition of being part of our community to adhere to certain basic conduct standards such as professional conduct, reliability, honesty, good workmanship, exempt of any form of discrimination, inappropriate behavior or misconduct. Users are not permitted to represent themselves as our employees or that they have the ability to bind us to certain actions. If any buyer or seller or provider does so, please inform us promptly.

As providers are solely responsible for determining the means and manner of selling or buying a good or service to another buyer and/or seller, and you understand that we do not have any control over or any oversight of how providers, buyers or sellers deliver the services. We are not responsible for delivering on or completing any transaction of good or service and we are not responsible for and will not be liable in any way for any acts or omissions of buyers and/or sellers and/or their employees and/or personnel and/or subcontractors.

We do not endorse, validate or verify the qualifications, skills or licenses of any providers and/or buyers and/or sellers nor will we be responsible for the performance, actions or inactions of any buyers and/or sellers and/or providers. You should therefore ensure that you carry out your own searches and ask questions of providers and/or buyers and/or sellers and/or their employees, subcontractors and other personnel, to satisfy yourself of their credentials and ability to perform a transaction you need performed, prior to contacting a buyer or seller or provider.

Rental providers, Guests and Rental Customers:

By using the Bizzcart Platform, you understand and acknowledge that we provide a booking and dispatch service that connects rental providers or hosts with customers (including their personnel and subcontractors) and that rental providers are fully independent and not employees or agents of Bizzcart.

We do not perform any of the rental provider services or bookings listed on the website. Although we do not control rental providers work product or behavior on the job site, rental providers are required, as a condition of being part of our community to adhere to certain basic conduct standards such as professional conduct, reliability, honesty, good workmanship and professional hosts, exempt of any form of discrimination, inappropriate behavior or misconduct. Rental providers are not permitted to represent themselves as our employees or that they have the ability to bind us to certain actions. If any rental provider does so, please inform us promptly.

Rental providers are solely responsible for determining the means and manner of making available or providing renting for an asset, furniture, good, or equipment to rental customers, and you understand that we do not have any control over or any oversight of how rental providers deliver the service to the rental providers. We are not responsible for delivering on or completing any service associated with the booking of a rental service and we are not responsible for and will not be liable in any way for any acts or omissions of rental providers and/or their employees or personnel.

We do not endorse, validate or verify the qualifications, skills or licenses of any rental providers nor will we be responsible for the performance, actions or inactions of any rental providers. You should therefore ensure that you carry out your own searches and ask questions of rental providers and/or their employees, subcontractors and other personnel, to satisfy yourself of their credentials and ability to provide the rental service you need, prior to booking with any rental provider for rental services.

Task Providers and Taskers:

By using the Bizzcart Platform, you understand and acknowledge that we provide a booking and dispatch service that connects Task Providers with Taskers or Freelancers (including their personnel and subcontractors) and that Task Providers and/or Taskers are fully independent and not employees or agents of Bizzcart.

We do not perform any of the Tasker services listed on the website. Although we do not control Taskers work product or behavior on the job site, Taskers are required, as a condition of being part of our community to adhere to certain basic conduct standards such as professional conduct, reliability, honesty and good workmanship, exempt of any form of discrimination, inappropriate behavior or misconduct. Taskers are not permitted to represent themselves as our employees or that they have the ability to bind us to certain actions. If any Tasker does so, rental inform us promptly.

Taskers are solely responsible for determining the means and manner of performing the Tasker Services to Task Providers, and you understand that we do not have any control over or any oversight of how Taskers deliver the Tasker Services. We are not responsible for delivering on or completing any tasks and we are not responsible for and will not be liable in any way for any acts or omissions of Taskers and/or their employees or personnel.

We do not endorse, validate or verify the qualifications, skills or licenses of any Taskers nor will we be responsible for the performance, actions or inactions of any Taskers or Freelancers. You should therefore ensure that you carry out your own searches and ask questions of Taskers and/or their employees, subcontractors and other personnel, to satisfy yourself of their credentials and ability to perform the services you need performed, prior to engaging any Tasker for Tasker Services.

Video Providers and Video Customers:

By using the Bizzcart Platform, you understand and acknowledge that we provide a service that allows video providers to post video to offer for subscription or purchase by video customer, and that video providers and video customers are fully independent and not employees or agents of Bizzcart.

We do not perform any of the content provider services listed on the website. Although we do not control video providers and/or video customers for the products and their behavior on the job site, video providers and/or video customers are required, as a condition of being part of our community to adhere to certain basic conduct standards such as professional conduct, reliability, honesty and good workmanship. Video providers and/or video customers are not permitted to represent themselves as our employees or that they have the ability to bind us to certain actions. If any video provider or video customer does so, please inform us promptly.

Video providers and/or video customers are solely responsible for determining the means and manner of selling or buying viewing rights of an online video, and you understand that we do not have any control over or any oversight of how video providers deliver the services. We are not responsible for delivering on or completing any transaction of online videos and we are not responsible for and will not be liable in any way for any acts or omissions of video customers and/or video providers and/or their employees or personnel.

We do not endorse, validate or verify the qualifications, skills or licenses of any video providers and/or video customers nor will we be responsible for the performance, actions or inactions of any video providers and/or video customers. You should therefore ensure that you carry out your own searches and ask questions of video providers and/or video customers and/or their employees, subcontractors and other personnel, to satisfy yourself of their credentials and ability to perform a transaction you need performed, prior to contacting them.

Rideshare Providers and Rideshare Customers:

By using the Bizzcart Platform, you understand and acknowledge that we provide a booking and dispatch service that connects Rideshare Providers and/or Drivers with Rideshare Customers (including their personnel and subcontractors) and that Rideshare Providers or Drivers are fully independent and not employees or agents of Bizzcart.

We do not perform any of the Rideshare services listed on the website. Although we do not control Drivers work product or behavior on the job site, Drivers are required, as a condition of being part of our community to adhere to certain basic conduct standards such as professional conduct, reliability, honesty and good workmanship, exempt of any form of discrimination, inappropriate behavior or misconduct. Drivers are not permitted to represent themselves as our employees or that they have the ability to bind us to certain actions. If any Driver does so, rental inform us promptly.

Drivers are solely responsible for determining the means and manner of performing the Rideshare Services to Rideshare Customers, and you understand that we do not have any control over or any oversight of how Drivers deliver the Rideshare Customer Services. We are not responsible for delivering on or completing any rideshare service and we are not responsible for and will not be liable in any way for any acts or omissions of Rideshare providers and/or Drivers and/or their employees or personnel.

We do not endorse, validate or verify the qualifications, skills or licenses of any Rideshare Providers and/or Drivers nor will we be responsible for the performance, actions or inactions of any Rideshare Providers and/or Drivers. You should therefore ensure that you carry out your own searches and ask questions of Rideshare Providers and/or Drivers and/or their employees, subcontractors and other personnel, to satisfy yourself of their credentials and ability to perform the services you need performed, prior to engaging any Rideshare Providers and/or Drivers for Rideshare Services.

Responsible Use and Conduct

By visiting our website and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as 'Resources'), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of these Terms and Conditions, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

Wherein, you understand that:

In order to access our Resources, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date.

You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your account/s.

Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.

Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.

Attempting to copy, duplicate, reproduce, sell, trade, or resell our Resources is strictly prohibited.

You are solely responsible of any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.

We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:

1. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
2. Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;

4. Impersonates any person or entity, including any www.bizzcart.com employees or representatives.

We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with these Terms and Conditions, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any third-party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

We do not assume any liability for any content posted by you or any other third-party users of our website. However, any content posted by you using any open communication tools on our website, provided that it doesn't violate or infringe on any third-party copyrights or trademarks, becomes the property of Bizzcart Inc., and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. All information provided as part of our registration process is covered by our Privacy Policy.

You agree to indemnify and hold harmless Bizzcart Inc. and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under these Terms and Conditions. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Users are not permitted to exchange contact information (including phone numbers, emails and full names) or post contact information on the Bizzcart Platform prior to an ad, task, rental, video, or rideshare being posted. Rental respect the privacy of other Users of the Bizzcart Platform and only use personal information to the extent necessary when using the Platform.

The following is a non-exhaustive list of the type of services that are prohibited from being requested, offered, negotiated or completed in relation to the Service by Users:

1. any service that would violate the law, rules, regulations, orders and/or legal rights of any person or entity in the jurisdiction of the User, Ad Provider, Task Provider, Rental Provider, Video Provider, Rideshare Provider, Tasker, Host, Guest, Driver, or the Customer, or in any other applicable jurisdiction, including without limitation, criminal laws and labour and employment laws;
2. any service that encourages or facilitates illegal activity;
3. pornographic or obscene services including sexual and escort services, offers and solicitations of prostitution, and pornography;
4. any services or contracts that the User, Ad Provider, Task Provider, Rental Provider, Video Provider, Rideshare Provider, Host or Guest has no legal right to request or that the User, Ad Provider, Task Provider, Rental Provider, Video Provider, Rideshare Provider, Host or Guest has no legal right to perform;
5. lottery, raffles, sweepstakes entries;
6. any services that would harm children or minors;
7. affiliate marketing, multilevel marketing or pyramid schemes; and
8. services related to spam, or unsolicited services or products, or false, misleading or fraudulent services.

Registration

In order to access the Bizzcart Platform and start posting ads, tasks, rentals, videos, and rideshares, users may be required to provide certain personal information as well as details such as the expertise of the tasker or driver. Any personal information provided by the User in the registration process and/or through use of the Bizzcart Platform will be treated in accordance with the terms of our Privacy Policy, which you should read carefully. For greater certainty, you can register as a User on behalf of a corporate entity, however you acknowledge and agree that Bizzcart reserves the right to verify the corporation’s existence.

How the Bizzcart Platform Works:

Posting an Ad

If you post an Ad on the Bizzcart Platform, you may be asked to provide certain information pertaining to the ad, including the category, the location, a brief description, the selling price or the amount you are willing to pay, and your email address.

Posting a Task

If you post a task on the Service, you may be asked to provide certain information pertaining to the task, including the location the task will be performed, the date and time of the requested Task Services, your email address, and the estimated time for the Services, as well as your credit/debit card information.

Assigning a Task

Once a task has been posted and approved, Taskers can accept tasks posted on the Bizzcart App based on qualifications, availability and geographic proximity. Once a Tasker has accepted a task, the Tasker will contact the Task Provider to confirm the time and place for the task. The Tasker and/or Task Provider may refer to our Help Centre or open a ticket by contacting us at [email protected] if there are any issues.

Posting a Rental

If you post a rental on the Bizzcart Platform, you may be asked to provide certain information pertaining to the rental, including the category, the location, a brief description of the rental offered, the rental price, rental or booking availabilities, rental rules, your email address, as well as your credit/debit card information.

Confirming Booking of a Rental

Rental customers can book rentals posted on the Bizzcart Platform or Bizzcart App based on the location, the price, amenities and other features offered by the Rental provider. Once a Rental provider has accepted the booking, a confirmation will be provided to the Rental customer by email and the amount of the rental will be withdrawn and kept on hold until the rental service has been completed. The Rental Provider and/or the Rental Customer may refer to our Help Centre or open a ticket by contacting us at [email protected] if there are any issues.

Posting a Video

If you post a video on the Bizzcart Platform, you may be asked to provide certain information pertaining to the video, including the category, a brief description of the video offered, the video viewing price and other information.

Confirming Purchase of Video Viewing Rights or Subscription

Video Customers can purchase a right to view videos posted on the Bizzcart Platform or Bizzcart App based on the categories, the price or other characteristics provided by the Video provider. Once a Video is purchased, a confirmation will be provided to the Video Customer by email and the amount of the video purchase will be withdraw. The Video provider and/or Video customer may refer to our Help Centre or open a ticket by contacting us at [email protected] if there are any issues.

Posting a Rideshare

If you post a rideshare on the Service, you may be asked to provide certain information pertaining to the rideshare, including the location, the route, the number of seats available to Rideshare customers, and date and the price of the requested Rideshare Services.

Performing a Rideshare

Once a Rideshare has been booked, Driver can accept the Rideshare Service requested by Rideshare Customer posted on the Bizzcart App. Once a Driver has accepted a Rideshare Service, the Driver will accept it and pickup the Rideshare Customer. The Rideshare Provider or the Driver or the Rideshare Customer may refer to our Help Centre or open a ticket by contacting us at [email protected] if there are any issues.

Cancellations

Task Providers are responsible for defining their own cancellation policy when a Tasker cancel a task. Task Providers must include their Cancellation Policy in the description of their task when it is posted on the Bizzcart website.

When the Task provider cancels a task assigned to a tasker within 72 hours of the task start time, a fee of thirty U.S. dollars ($30) may be charged by Bizzcart.

Rental Providers are responsible for setting their own cancellation policy when a Rental Customer or Tenant cancel a booking. Rental Providers must include their Cancellation Policy in the description of their rental when it is posted on the Bizzcart website.

When the Rental provider cancels the booking of a rental confirmed with a customer within 72 hours of the rental start time, a fee of thirty U.S. dollars ($30) may be charged by Bizzcart.

Rideshare Providers are not responsible for defining their own cancellation policy when a Rideshare Customer cancel a rideshare. Bizzcart sets the cancellations policies for Rideshare Provides or Drivers and for Rideshare Customers.

When the Rideshare Customer cancels a ride assigned to a driver within 24 hours of the ride start time, a fee of five U.S. dollars ($5) may be charged by Bizzcart.

Bizzcart reserves the right to waive the cancellation fees under circumstances it deems, in its sole discretion, to be suitable. The decision of Bizzcart to waive such cancellation fees shall be deemed as final.

Cancellation fees applicable for Bizzcart service providers and customers may vary by country and subject to be modified by Bizzcart.

Re-scheduling

When the Task provider reschedules a task assigned to a Tasker within 72 hours of the task start time, a fee of thirty U.S. dollars ($30) may be charged by Bizzcart.

When the Rental Provider reschedules the booking of a rental confirmed with a customer within 72 hours of the rental start time, a fee of thirty U.S. dollars ($30) may be charged by Bizzcart.

Bizzcart reserves the right to waive the re-scheduling fees under circumstances it deems, in its sole discretion, to be suitable. The decision of Bizzcart to waive such cancellation fees shall be deemed as final.

Re-scheduling fees applicable for Task provider and Rental Provider may vary by country and subject to be modified by Bizzcart.

Recurring Plan

At any time, if a recurring plan is cancelled by the Task provider or the Rental Provider, an additional twenty U.S. dollars ($20) fee may be charged by Bizzcart.

Bizzcart reserves the right to waive the recurring plan cancellation fees under circumstances it deems, in its sole discretion, to be suitable. The decision of Bizzcart to waive such cancellation fees shall be deemed as final.

Recurring Plan cancellation fees applicable for Task provider and Rental Provider may vary by country and subject to be modified by Bizzcart.

Tasker or Rental provider or Driver Non-Attendance

If a Tasker fails to show up to perform a task assigned to him/her, Bizzcart has the right to suspend the Tasker and charge a 100% of the Task value from the Tasker's earnings or recover this from him/her. Bizzcart’s decision will be final.

If a Rental provider fails to show up to a rental booked to him/her, Bizzcart has the right to suspend the Rental provider and charge a 100% of the rental value from the Rental provider's earnings or recover this from him/her. Bizzcart’s decision will be final.

If a Driver fails to show up to perform a rideshare assigned to him/her, Bizzcart has the right to suspend the Driver and charge a 100% of the Rideshare value from the Driver's earnings or recover this from him/her. Bizzcart’s decision will be final.

Bizzcart does not tolerate any violation and the tasker or rental provider or driver account may be suspended from the website.

Completion and Billing of a Task or a Rental

When a task has been completed, the Task provider will be charged the final amount of the Services to his/her payment card that we have on file. The Task provider will be charged a payment processing fee as well. Note that the payment processing fee is approximately 2.9% plus 30 cents of the total transaction but could change, as determined by our payment processor. Taskers are paid only after Task providers have made payment for the Services.

When a rental has been completed, the Rental customer will be charged the final amount of the Services to his/her payment card that we have on file. The Rental customer and Rental providers may be charged a payment processing fee as well. Ad, Task, Rental, Video, and Rideshare Completion Disputes

Ad providers, buyers and/or sellers have 24 hours from the transaction related to the ad posting to file a dispute. Disputes may be filed by calling or emailing us and providing us with evidence such as photographs and narration. Bizzcart will take fourteen (14) days to review and provide a response to any complaints. Any decision by Bizzcart will be deemed final.

Task providers and/or Taskers have 24 hours from the completion of the task to file a dispute. Fees, Taxes and Payment Terms:

Ad, Task, Rental, Video and Rideshare Fees

The fees for posting a service on Bizzcart are pre-determined by Bizzcart in its sole discretion. By posting an ad, the buyer or the seller posting the ad agrees to pay the ad fee, and any electronic fund transfer fee charged by the payment processor. Payments are done only using credit, debit cards or Paypal on the website or Bizzcart App. ("Ad Fee").

The task fees are pre-determined by Bizzcart in its sole discretion. By posting a task, the Task provider agrees to pay the task fee, and any electronic fund transfer fee charged by the payment processor. Payments are done only using credit, debit cards or Paypal on the website or Bizzcart App. ("Task Fee").

The rental fees are pre-determined by Bizzcart in its sole discretion. By posting a rental, the Rental Provider agrees to pay the rental fee, and any electronic fund transfer fee charged by the payment processor. Payments are done only using credit, debit cards or Paypal on the website or Bizzcart App. ("Rental Fee").

The video fees are pre-determined by Bizzcart in its sole discretion. By posting a video, the video provider agrees to pay the video fee, and any electronic fund transfer fee charged by the payment processor. Payments are done only using credit, debit cards or Paypal on the website or Bizzcart App. ("Video Fee").

The rideshare fees are pre-determined by Bizzcart in its sole discretion. By posting a rideshare, the rideshare provider agrees to pay the rideshare fee, and any electronic fund transfer fee charged by the payment processor. Payments are done only using credit, debit cards or Paypal on the website or Bizzcart App. ("Rideshare Fee").

Taxes

The Ad Fee, Task Fee, Rental Fee, Video Fee and Rideshare Fee are exclusive of taxes. Accordingly, Buyers or Sellers posting an ad, task providers posting a task, rental providers posting a rental, video provider posting a video, and rideshare provider posting a rideshare and not Bizzcart are responsible for paying any applicable tax on an Ad, a Task, a Rental, a Video or a Rideshare, including without limitation, sales tax, value added taxes, any and other local, provincial or federal taxes, levies, duties or tariffs.

Refunds

The purchases and/or bookings are final (subject to the above cancellation policy); accordingly, it is not the policy of Bizzcart to issue refunds. In the event that an Ad, a Task, a Rental, a Video, a Rideshare is entitled to a refund, the Service Provider will be liable for the same, meaning that if a Service Provider or a Customer is entitled to a refund and initiates a refund on Paypal, a credit card or other payment method, Bizzcart will charge the Service Provider or the Customer the complete amount of the chargeback for the applicable transaction.

Bizzcart Fees

Browsing the Bizzcart website, downloading the Bizzcart App and setting up an account are all free of charge.

There is no fee for posting a first ad on the Post Ad section of the Bizzcart website. Fee applies for posting additional ads as described in the Post Ad section of the Bizzcart website.

There is no fee for posting a task on the Post Task section of the Bizzcart website. Once a task has been assigned to a tasker, an amount is kept on hold from the task provider and will be withdrawn upon completion of the task. Once a task is completed, Bizzcart will make a payment to the tasker. Bizzcart charges 5% commission to the task provider and to the tasker on completed transactions.

There is no fee for posting a rental on the Post Rental section of the Bizzcart website. Once a reservation for a rental has been confirmed, an amount is kept on hold from the rental provider (or host or tenant) and will be withdrawn upon completion of the rental service. Once the rental service is completed, Bizzcart will make a payment to the Rental provider. Bizzcart charges 5% commission to the rental provider and to the rental holder on completed transactions.

There is no fee for posting a video on the Post Video section of the Bizzcart website. Once a purchase for a video has been made, an amount will be withdrawn and Bizzcart will make a payment to the Video provider. Bizzcart charges 5% commission to the Video provider and to the Video Customer on completed transactions.

There is no fee for posting a rideshare on the Post Rideshare section of the Bizzcart website. Once a rideshare is completed, an amount will be withdrawn and Bizzcart will make a payment to the Driver. Bizzcart charges 5% commission to the Driver and to the Rideshare Customer on completed transactions.

Bizzcart charges a fee for using its bump up service. This service is offered to users who wish to boost their ads, tasks, rentals, videos and rideshares to increase the exposure of their posted items. Fees for the boost service are described in the Post Ad, Post Task, Post Rental, Post Video, and Post Rideshare sections of the Bizzcart website.

Bizzcart charges a fee for using its advertisement placement service. This service is offered to users who wish to place their ad, task, rental, video or rideshare on a dedicated section of the Bizzcart website for advertisements. Advertisement fees are described in the Post Ad, Post Task, Post Rental, Post Video, and Post Rideshare sections of the Bizzcart website.

Users of the Task, Rental, Video, and Rideshare sections of the Bizzcart website are required to make their transactions online using the Bizzcart website and its payment gateway.

Users of the Ad section of the Bizzcart website are expected to make their transactions between Users in cash, by cheque or by mobile payment. Transactions between users using the Ad section of the Bizzcart website are not handled nor processed via our website, and they are expected to be done in person.

Taskers are not allowed to take cash from Task providers for any tasks completed in connection with the Bizzcart website or Service, and Task providers should notify Bizzcart if any Tasker requests cash payments for the Task Services. Bizzcart has the right to withhold payments from Taskers if there are any complaints or disputes between the Tasker and a Task provider. Bizzcart will mediate all disputes between Task providers and Taskers and Bizzcart’s decision will be deemed as final and cannot be challenged. Taskers are NOT allowed to contact Task providers directly in the event of a dispute.

Rental providers are not allowed to take cash from Rental customers for any rentals or booking completed in connection with the Bizzcart website or Service, and Rental customers providers should notify Bizzcart if any Rental provider requests cash payments for his/her rental service. Bizzcart has the right to withhold payments from the Rental Provider if there are any complaints or disputes between the Rental Provider and a Rental Customer. Bizzcart will mediate all disputes between Rental provider and Rental customer and Bizzcart’s decision will be deemed as final and cannot be challenged. Rental Providers are NOT allowed to contact Rental customers directly in the event of a dispute.

Video providers are not allowed to take cash from Video customers for any purchases or subscriptions in connection with the Bizzcart website or Service, and Video customers should notify Bizzcart if any Video provider requests cash payments for his/her video service. Bizzcart has the right to withhold payments from the Rideshare provider if there are any complaints or disputes between the Rideshare Provider or Driver and a Rideshare Customer. Bizzcart will mediate all disputes between Rideshare providers and Rideshare customers and Bizzcart’s decision will be deemed as final and cannot be challenged. Rideshare providers are NOT allowed to contact Rideshare customers directly in the event of a dispute.

Changes to Bizzcart Fees

Bizzcart reserves the right to change the Service Fee or implement charges for other features of the Bizzcart Service as indicated to Users from time to time. Any revised fees will take effect 7 days from the date of posting on the website or notification to your account.

Insurance

Bizzcart does not carry insurance which provides coverage in the event of property damage or bodily injuries.

Content

All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, whether publicly posted or privately transmitted to the Bizzcart Platform by Users whether in forums or otherwise ("User Content), is the sole responsibility of such Users. This means that the viewer or user, and not Bizzcart, are entirely responsible for all such material uploaded, posted, emailed, transmitted or otherwise made available by using the Bizzcart Platform.

Bizzcart does not control or actively monitor User Content and, as such, does not guarantee the accuracy, integrity or quality of such content. Users acknowledge that by using the Bizzcart Platform, they may be exposed to materials that are offensive, indecent or objectionable. Under no circumstances will Bizzcart be liable in any way for any materials, including, but not limited to, for any errors or omissions in any materials or any defects or errors in any printing or manufacturing, or for any loss or damage of any kind incurred as a result of the viewing or use of any materials posted, emailed, transmitted or otherwise made available via the Service or for any loss or damage arising from a third party security breach or cyber attack on Bizzcart servers or databases.

Restrictions on User Content and Use of the Bizzcart Platform

Bizzcart reserves the right at all times (but will have no obligation) to remove or refuse to distribute any User Content and to terminate users or reclaim usernames. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms and Conditions, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of our users and the public.

License of Content

By submitting, posting or displaying User Content on or through the Bizzcart Platform, you grant us (and our agents) a non-exclusive, royalty-free license (with the right to sublicense) to use, copy, modify, transmit, display and distribute such User Content. Bizzcart will not be responsible or liable for any use of User Content in accordance with these Terms and Conditions. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any User Content that you submit.

End User License

Except for User Content, the Bizzcart Platform, the Bizzcart App, the website, and the information and materials that it contains, are the property of Bizzcart and its licensors, and are protected from unauthorized copying and dissemination by copyright law, trademark law, and other intellectual property laws. Subject to the terms of these Terms and Conditions, Bizzcart grants you a non-transferable, non-exclusive, license to (a) use the website for your use, and (b) download, install and use one copy of the Application on a mobile device that you own or control for your use (the “License”). The Bizzcart App is licensed to you and not sold. Nothing in the Terms gives you a right to use the Bizzcart or Bizzcart names, trademarks, logos, domain names, and other distinctive brand features without our prior written consent. You shall not attempt to override or circumvent any of the usage rules or restrictions on the website. Any future service, update, or other addition to functionality of the website or Bizzcart App shall be subject to the terms of these Terms and Conditions.

4. any defects in the operation or functionality of any Resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:

1. any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
2. no information or advice, whether expressed, implied, oral or written, obtained by you from Bizzcart Inc. or through any Resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.

Limitation of Liability

You expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Bizzcart Inc. will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

You understand and agree that the buyer services, seller services, tasker services, rental provider services, video provider services, and rideshare provider services are provided by independent contractors or freelancers and not by Bizzcart. Under no circumstances will Bizzcart have any liability for any of the acts or omissions of any of the buyers, sellers, taskers, rental providers video providers, or rideshare providers and their actions or services or transactions provided in connection with the provision of services under this agreement.

Under no circumstances shall Bizzcart be liable for any direct, indirect, incidental, special, consequential, exemplary or other damages whatsoever, including, without limitation, any damages that result from (i) your use of or your inability to use this website, Bizzcart App or the Bizzcart Services, (ii) the cost of procurement of substitute goods, data, information or services, (iii) errors, mistakes, or inaccuracies in the materials on the website, (iv) personal injury or property damage of any kind whatsoever arising from or relating to your use of the service, any bugs, viruses, Trojan horses, or any other files or data that may be harmful to computer or communication equipment or data that may have been transmitted to or through the website or Bizzcart App, (v) any acts or omissions, negligence, breach of contract, or other conduct of any tasker and/or driver and/or their employees, subcontractors and personnel; or (iv) any errors or omissions in any material on the website or any other loss or damage of any kind arising from or relating to your use of the website. These limitations shall apply even if Bizzcart has been advised of the possibility of such damages.

Notwithstanding anything to the contrary contained herein, Bizzcart’s liability to you for any damages arising from or related to this agreement (for any cause whatsoever and regardless of the form of the action), will at all times be limited to the greater of (a) fifty U.S. dollars ($50) or (b) amounts you’ve paid Bizzcart in the prior 6 months (if any). The foregoing limitations shall apply to the fullest extension permitted by law in the applicable jurisdiction.

THE WEBSITE, BIZZCART SERVICES, BIZZCART APP AND ALL MATERIALS PROVIDED THEREIN, INCLUDING TASKER SERVICES, RENTAL PROVIDER SERVICES, BUYER SERVICES, SELLER SERVICES, VIDEO PROVIDER SERVICES, AND RIDESHARE PROVIDER SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE”. BIZZCART SPECIFICALLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EITHER EXPRESS, IMPLIED, STATUTORY, BY USAGE OF TRADE, COURSE OF DEALING OR OTHERWISE INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE. ANY INFORMATION OR MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR ANY OTHER LOSS THAT RESULTS FROM DOWNLOADING OR USING ANY SUCH MATERIAL. BIZZCART DOES NOT WARRANT, ENDORSE, GUARANTEE, PROVIDE ANY CONDITIONS OR REPRESENTATIONS, OR ASSUME ANY RESPONSIBILITY FOR THE AD SERVICES, TASKER SERVICES, THE RENTAL SERVICES, THE VIDEO SERVICES, THE RIDESHARE SERVICES OR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY ANY USER OR THIRD PARTY THROUGH THE WEBSITE OR IN RESPECT TO ANY WEBSITE THAT CAN BE REACHED FROM A LINK ON THE WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING ON THE WEBSITE, AND BIZZCART SHALL NOT BE A PARTY TO ANY TRANSACTION THAT YOU MAY ENTER INTO WITH ANY SUCH USER OR THIRD PARTY. BIZZCART WILL NOT BE LIABLE FOR ANY TYPE OF CONTENT EXCHANGED BY MEANS OF THE SERVICE.

INDEMNIFICATION

YOU SHALL INDEMNIFY AND HOLD BIZZCART AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, AND EMPLOYEES, HARMLESS FROM ALL CLAIMS, ACTIONS, PROCEEDINGS, DEMANDS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES), INCURRED IN CONNECTION WITH ANY MATERIALS SUBMITTED, POSTED, TRANSMITTED OR MADE AVAILABLE BY YOU THROUGH THE SERVICE AND/OR ANY VIOLATION BY YOU OF THESE TERMS AND CONDITIONS OR OF ANY APPLICABLE LAW OR REGULATION.

UNLESS OTHERWISE EXPRESSED, BIZZCART INC. EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Feedback and Rating

If you provide Bizzcart with any suggestions, testimonials, comments or other feedback relating to any aspect of the website, Bizzcart App and/or Bizzcart Services ("Feedback"), Bizzcart may use such Feedback in the website, the Bizzcart App or in any other Bizzcart products or services (collectively, "Bizzcart Offerings"). Accordingly, You agree that: (a) Bizzcart is not subject to any confidentiality obligations in respect to the Feedback, (b) the Feedback is not confidential or proprietary information of You or any third party and You have all of the necessary rights to disclose the Feedback to Bizzcart, (c) Bizzcart (including all of its successors and assigns and any successors and assigns of any of the Bizzcart Offerings) may freely use, reproduce, publicize, license, distribute, and otherwise commercialize Feedback in any Bizzcart Offerings, and (d) You are not entitled to receive any compensation or re-imbursement of any kind from Bizzcart or any of the other users of the website in respect of the Feedback.

Buyers have the option to rate and provide feedback on their experience with the sellers using our star rating system and/or written comments (“Buyer Feedback”). Buyer Feedback will be posted on seller profiles which may be viewable by other Users.

Advertising

You acknowledge and agree that the website may contain advertisements. If You elect to have any business dealings with anyone whose products or services may be advertised on the website, you acknowledge and agree that such dealings are solely between You and such advertiser and You further acknowledge and agree that Bizzcart shall not have any responsibility or liability for any losses or damages that You may incur as a result of any such dealings.

Because Bizzcart does not supervise or control interactions between Task providers and Taskers, between Buyers and Sellers, between Rental providers and Rental customers, between Video providers and Video customers, between Rideshare providers or Drivers and Rideshare Customers, and because Bizzcart does not control credit card companies or other payment processing companies, and because Bizzcart does not screen or monitor the completion of tasks, of rentals or other transactions, and because Bizzcart cannot guarantee the true identity, age, or nationality of Ad providers and Ad customers, Task providers and Taskers, Rental providers and Rental customers, Video providers and video customers, Rideshare providers and rideshare customers, and because Bizzcart has very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of the website you agree that you bear all risk and you agree to re-rental Bizzcart (and their officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with your use of the website, your third party transactions and in connection with Bizzcart’s resolution of any disputes between Task providers and Taskers, between Rental Providers and Rental customers, between Buyers and Sellers, between Ad providers and Ad customers, between Video providers and Video customers, between Rideshare providers and Rideshare customers.

You further waive any and all rights and benefits otherwise conferred by any statutory or non-statutory law of any jurisdiction that would purport to limit the scope of a re-rental or waiver. Task providers and Taskers, Rental Providers and Rental customers, Buyers and Sellers, Ad providers and Ad customers, Video providers and Video customers, Rideshare providers and Rideshare customers, are solely responsible for verifying the identity of other Task providers and Taskers, other Rental Providers and Rental Customers, other Buyers and Sellers, other Ad providers and ad customers, other Video providers and Video customers, other Rideshare providers and Rideshare customers that they engage with and should take necessary precautions to ensure their safety and security when engaging with them.

Availability & Updates

Bizzcart may alter, suspend, or discontinue this website at any time and for any reason or no reason, without notice. The website, Bizzcart Services and/or Bizzcart App may be unavailable from time to time due to maintenance or malfunction of computer or network equipment or other reasons. Bizzcart may periodically add or update the information and materials on this website without notice.

Security

Information sent or received over the Internet is generally unsecure and Bizzcart cannot and does not make any representation or warranty concerning security of any communication to or from the website or any representation or warranty regarding the interception by third parties of personal or other information. Termination of Use

Disputes and Complaints

If you are dissatisfied with the performance of any Services, you must report the issue within twenty-four (24) hours. If you do not report an issue within that time period, you waive your right to dispute the issue. Bizzcart is not responsible for refunding or reimbursing any User for fees paid to another party. Additionally, because Bizzcart is an online marketplace only, we ask that you first attempt to resolve a dispute with a Service provider or a Customer.

You can contact the Service provider or the Customer directly by text message or by calling the number listed for the individual in the app. If you are unable to resolve a dispute with a Service provider or a Customer without Bizzcart’s assistance, then if Bizzcart considers a complaint valid and such complaint relates to non-attendance, abusive or unprofessional conduct by You, Bizzcart may, in its sole discretion, intervene and assist with mediating the dispute. Although we make attempts to solve disputes amicably, we make no guarantees that we will be able to solve any disputes between Users.
